1. About these terms

These terms govern the use of this website and the services provided by The Notary Solution Limited, a company registered in England and Wales with company number 09906564. By using this website or instructing us, you accept these terms. If you do not accept them, please do not use the website or our services.

2. The service we provide

We provide information, documentation and process support in relation to patents, copyright, trade marks, registered designs and intellectual property portfolios. Our work covers explaining how a procedure operates, identifying the documents and information a filing requires, preparing and checking that documentation, and administering the correspondence and deadlines involved. We do not provide legal advice and we do not represent clients in legal proceedings.

3. No legal advice and no professional representation

Nothing on this website, and nothing in our correspondence, constitutes legal advice or creates a professional legal relationship. We are not instructed as your legal representative in any matter. Where your circumstances require legal advice, an opinion on infringement or validity, or representation before a court or tribunal, you must instruct a suitably qualified legal professional. We will tell you when we consider that to be necessary.

4. Scoping, fees and payment

Work is quoted by stage. Before any stage begins you receive a written scope confirming what will be prepared, the indicative fee for that stage, any disbursement or official fee that will be incurred, and the information we require from you. Work begins only once you have confirmed the scope in writing. Official fees charged by a patent, trade mark or design office are set by that office and are passed on at cost. Invoices are payable within the period stated on the invoice.

5. Cancellation and refunds

You may cancel a stage at any time before work on it has begun and any fee paid for that stage will be refunded in full. Where a stage has already begun, the fee for work completed up to the point of cancellation remains payable and the balance is refunded within 14 days. Fees already paid to a patent, trade mark or design office, or incurred as a disbursement on your behalf, cannot be refunded by us once they have been submitted to that office. Requests to cancel should be sent in writing to support@notarysolution.support.

6. Information you provide

You are responsible for the accuracy and completeness of the information and documents you provide. We rely on what you send us, and we do not verify ownership, entitlement or the accuracy of technical descriptions independently unless that is specifically included in the written scope. Delays or additional costs arising from inaccurate or incomplete information are not our responsibility.

7. Outcomes, deadlines and third parties

Whether an application is granted, registered or accepted is decided by the relevant office, not by us, and we cannot guarantee any particular outcome. Deadlines set by an office or by law are met on the basis of the information available to us at the time, and we are not responsible for a deadline that changes without notice from the office concerned. Where we pass on an official fee, it is collected on behalf of that office.

8. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our liability arising out of or in connection with a matter is limited to the fees paid to us for the stage of work to which the claim relates, and we are not liable for indirect or consequential loss, including loss of profit, loss of opportunity or loss of expected rights.

9. Intellectual property and website content

The content of this website is provided for general information. It is not tailored to any particular set of circumstances and must not be relied on as advice. We may update, amend or withdraw any part of the website without notice.

10. Governing law

These terms, and any dispute or claim arising out of or in connection with them or the services, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
